Terms and conditions
The agreements that apply to our quotations, assignments, hosting and services.
Please note: this is a draft set of terms and conditions. Have this text reviewed by the owner and preferably by a lawyer before you publish it, and replace it with your own terms if necessary.
1. Applicability
These terms apply to all offers, quotations and agreements of Dave’s Websites, Emmen, Chamber of Commerce (KvK) number 89405544, unless agreed otherwise in writing.
2. Quotations and agreement
Quotations are non-binding and valid for the period stated in them. An agreement is concluded once you have accepted the quotation in writing or by email. Changes to the assignment may affect price and planning; we will agree these with you in advance.
3. Performance of the assignment
We carry out the assignment to the best of our knowledge and ability. Planning and delivery dates are indicative unless expressly agreed as a strict deadline. So that we can carry out the assignment properly, you provide the necessary copy, images and information in good time.
4. Prices and payment
All prices stated are exclusive of VAT unless stated otherwise. Payment is due within the period stated on the invoice. If payment is late, we may suspend our work.
5. Hosting, domain names and backups
Separate terms and durations may apply to hosting and domain names. We make backups as agreed, but the client remains responsible for the accuracy and lawfulness of the content that is published.
6. Intellectual property
Intellectual property rights in components developed by us remain with us, unless agreed otherwise in writing. After full payment you receive a right of use for the delivered website. Materials supplied by you remain yours.
7. Liability
Our liability is limited to direct damage and to a maximum of the amount invoiced for the assignment concerned, to the extent permitted by law. We are not liable for indirect damage, such as loss of profit or loss of data.
8. Complaints
Please report complaints as soon as possible, within a reasonable period after discovery, via info@daveswebsites.nl. We will aim to reach a solution in consultation with you.
9. Governing law
Dutch law applies to all agreements. Disputes will be submitted to the competent court in the Netherlands.
